Amicus curiae appointed in contempt case in Delhi High Court, Rajdeepa Behura will fight Arvind Kejriwal’s case.

Delhi High Court on Friday gave an important order in the criminal contempt case based on alleged comments and social media posts related to Justice Swarn Kanta Sharma. The court has appointed an Amicus Curiae to ensure a fair hearing of the case. The division bench hearing the case, comprising Justice Naveen Chawla and Ravindra Duggal, has appointed senior advocate Rajdeepa Behura as amicus curiae. The court said that this appointment has been made so that the hearing of the case is not affected and the arguments of all the parties can be presented in a balanced manner. It was also told that Rajdeepa will present arguments on behalf of Arvind Kejriwal in the Behura case.

The case pertains to alleged comments and social media content made by Justice Swaran Kanta Sharma, which is alleged to have attempted to influence the dignity of the court and the judicial process. The division bench conducting the hearing has appointed senior advocate Rajdeepa Behura as amicus curiae. The court said that considering the sensitivity of the case, impartial assistance is necessary, so that a balanced opinion can be given on all legal aspects. The court has already issued notice to Arvind Kejriwal as well as other parties including Saurabh Bhardwaj.

What happened in the High Court today

This hearing is being conducted by the division bench of Justice Naveen Chawla and Justice Ravindra Duggal. The court said that it has already initiated contempt proceedings in this matter by taking suo motu cognizance. Now the court has clarified that both the cases related to this case will be heard together, so that there is uniformity and coordination in the hearing. The case pertains to alleged comments and social media content relating to Justice Swarn Kanta Sharma, who have been accused of influencing the dignity of the court and the judicial process.

The first case pertains to the suo motu taken by Justice Swarn Kanta Sharma. In this, under the order given on May 14, criminal contempt proceedings were initiated against Arvind Kejriwal and other Aam Aadmi Party leaders. The second case pertains to a petition filed by advocate Ashok Chaitanya. Along with Arvind Kejriwal, journalists Saurav Das, Saurabh Bhardwaj and Gopal Rai have also been made parties in this petition. According to the report, before filing this petition, necessary consent was taken from Delhi Government’s Additional Standing Counsel (Criminal) Sanjeev Bhandari.

The bench will hear both the cases together

The court said contempt proceedings have already been initiated against Arvind Kejriwal and Saurabh Bhardwaj on almost similar allegations and notices have been issued to them. However, the court also clarified that Gopal Rai and journalist Saurav Das were not parties to the suo motu case. For this reason, the court has ordered him to issue notice without process fee. Along with this, the court also directed that copies of the documents and materials used in the present petition should also be made available to Arvind Kejriwal and Saurabh Bhardwaj, so that all the parties can get an equal opportunity to present their case.
