Big decision of Supreme Court amid allegations and counter-allegations of Bengal Government-ECI, said- judicial officers will be appointed for SIR

New Delhi. Judicial officers will be involved in the Special Intensive Revision (SIR) process of electoral rolls in West Bengal. The Supreme Court on Friday gave this decision in view of the deadlock between the West Bengal Government and the Election Commission. The Supreme Court has asked the Chief Justice of Calcutta High Court to depute some serving and former ADJ rank judicial officers to help in deciding the objections and claims filed by the people in the SIR process.

The court directed the state government to cooperate with the High Court and create an environment for their work. While giving the verdict, the court said that this decision has been taken in view of the extraordinary situation in West Bengal. However, the Supreme Court acknowledged that this instruction may impact the hearing of normal court cases as judges’ time may be diverted for the SIR process. On Friday, the bench of Supreme Court Chief Justice Surya Kant, Justice Joymatya Bagchi and Justice Vipul M. Pancholi heard the petition filed by West Bengal Chief Minister Mamata Banerjee.

Advocate Kapil Sibal, appearing for the state, told the court that the deadline was extended till February 21, but the Commission stopped uploading the documents on February 15 itself. Advocate DS Naidu, representing the Election Commission, accused the Bengal government of not providing officers. The court expressed displeasure over the attitude of the West Bengal Government and said that the state government has failed to provide qualified officers for ERO-AERO.

The Supreme Court also commented strongly on the issue of inflammatory and threatening speeches. The CJI said that unfortunately in this country all these (provocative) statements are made during elections. He said that there is a bad atmosphere of allegations and counter-allegations, which shows the lack of trust between the two constitutional institutions, the Election Commission and the state government. The Supreme Court directed the Director General of Police to file an affidavit with information about the complaints received so far and the steps taken. The next hearing in this case will be held in the first week of March.
