Aravalli case: Supreme Court gives instructions to form a committee, strict instructions to the state government on illegal mining

On Wednesday, a three-judge bench headed by Chief Justice (CJI) Surya Kant heard the case. The Supreme Court has given instructions to form a committee in the matter. The CJI said that the court is considering more strict monitoring. he saidwe will form a committee, In which there will be experts in their respective fields. This committee will give report regarding Aravali. The committee will work under the instructions and guidance of the court.

Advocate Raju Ramachandran, appearing for the farmers of Rajasthan, told the court that despite the 2024 orders of Justice Oka Bench, mining leases are being given and trees are being cut. He demanded a stop on this. Chief Justice Surya Kant expressed concern over this and said that illegal mining has to be stopped. This is a crime.

The Supreme Court asked the Rajasthan government to ensure that no illegal mining takes place. The court appealed to all parties including environmentalists, Asked for suggestions regarding names of scientists and mining experts.

The Supreme Court once again made an important comment on the ongoing controversy regarding the definition of Aravalli Hills, saying that this issue is not merely technical., Rather, it is linked to the environmental future of the country. The court gave clear instructions that any kind of illegal mining will not be tolerated in the Aravali region., Because the consequences of such mining are “irreparable and far-reaching”, Which is not possible to improve later.

The Supreme Court also reiterated that there is a need for a High Court to decide on a scientific and clear definition of Aravali.Powered committee will be formed. Environment in this committee, forestry, EarthIndependent experts from science and related fields will be involved. The court heard from all parties, Including Amicus Curiae, Has been asked to present the names and suggestions of possible members of the committee within four weeks.

The court has also extended the stay on its old decision., In which it was recommended to consider only the hills more than 100 meters high as Aravali. This recommendation of the Environment Ministry’s committee had already been postponed by the court, calling it worthy of reconsideration. The court believes that this issue is sensitive and cannot be decided in haste. Therefore, the new expert committee will recommend a new definition on factual and scientific basis.

During the hearing, a lawyer raised the issue of ongoing illegal mining in many areas of Rajasthan. On this, the court directed the lawyer of Rajasthan government to ensure immediate action and said that an environmental area like Aravali cannot bear the burden of any kind of negligence. The court also said that illegal mining directly affects the environmental rights of future generations., Therefore, the court will thoroughly investigate all aspects of this entire matter.

The court also made it clear that the interim order passed in December last year will remain in force till further orders. as well as, Intervenors (Intervenors) have been directed to contact the Amicus Curiae and submit their comments and report. Amicus Curiae has been directed to include all these suggestions in his comprehensive report. Now the next hearing of this case will be after four weeks, In which the court can take a decision on committee formation and further process.
