Big blow to Kuldeep Sengar in Unnao case, Delhi High Court rejects the petition

In the case related to Unnao incident, Delhi High Court has given a big blow to former BJP MLA Kuldeep Singh Sengar (Kuldeep Sengar Delhi High Court). The court has rejected his petition citing ill health, in which he had sought suspension of the 10-year sentence awarded in the case of custodial death of the Unnao rape victim’s father.

The High Court made it clear that there is no basis for suspension of sentence at this stage. After this order of the court, Kuldeep Sengar has not been able to get any kind of relief at present. Earlier, Sengar has been sentenced to different punishments in the same case, on which he is fighting a judicial battle.

It is noteworthy that earlier the Delhi High Court had stayed the life sentence given to Kuldeep Singh Sengar in the Unnao rape case (Kuldeep Sengar Delhi High Court). The case against that order reached the Supreme Court, where the country’s highest court had stayed the bail granted to Sengar and also gave the victim the option to file a separate petition.

After the Supreme Court’s decision, the victim’s side had expressed relief. At that time the victim’s mother had said that she had faith in the judiciary and the safety of her family and lawyers should be ensured. He also said that the Supreme Court has done justice to him.

This case is of the year 2017, when an incident of rape of a minor girl came to light in Unnao. In December 2019, a special court in Delhi had convicted Kuldeep Singh Sengar (Kuldeep Sengar Delhi High Court) and sentenced him to life imprisonment under various sections of the Indian Penal Code and POCSO Act. The court had also imposed a fine of Rs 25 lakh on him.

After the latest order of Delhi High Court, it has become clear that the courts are adopting a very strict stance regarding suspension of punishment in serious cases. This decision once again gives the message that position and influence do not matter before the law.
