Big blow to Kuldeep Sengar, Supreme Court stays the order of High Court

Tezzbuzz Desk- Former MLA Kuldeep Sengar has received a big blow from the Supreme Court. The Supreme Court has put a stay on the order of Delhi High Court to suspend his sentence. The apex court has made it clear that even if suspension of sentence has been ordered, Kuldeep Sengar will not be able to come out of jail at present.

During the hearing of this case, Solicitor General Tushar Mehta took a strong stand in the Supreme Court and said that the age of the victim was less than 16 years at the time of the incident, which makes the matter very serious. He said that the appeal in this case is still pending and in such a situation a stay on suspension of sentence is necessary.

The counsel appearing for CBI argued that the trial court has undisputedly convicted Kuldeep Sengar under Section 376 of the Indian Penal Code. He said that under Section 376 (1) of the IPC, the minimum punishment is 10 years and the maximum punishment is life imprisonment.

The Solicitor General also clarified that if the case falls under Section 376(2), then the minimum punishment can be 20 years and the maximum punishment can be imprisonment till the end of the biological life of the accused. Since the victim was below 16 years of age, this case falls in the category of harshest punishment.

After this decision of the Supreme Court, it has become clear that Kuldeep Sengar will not get any relief at the moment and he will remain in jail until a final decision is taken in the case.
