Big decision in online child sexual exploitation case: Delhi High Court overturns the order giving relief to the accused

New Delhi, 7 April. In a case related to online child sexual abuse, the Delhi High Court, while giving an important verdict, canceled the trial court’s order in which two accused, Raman Kumar and Sandeep Singh alias Lovely, were discharged. The High Court in its order dated April 4, 2026 has clearly said that charges should be framed (framing of charges) against both the accused. This information was given in a press note issued by CBI on Monday.

According to the press note issued by the CBI, this case was registered by the Central Bureau of Investigation (CBI), in which the main accused Raman Gautam and other unknown persons are accused of dissemination of obscene and exploitative content related to children (Child Sexual Abuse Material – CSAM). Investigation revealed that the accused were sharing links, videos, photographs, texts and posts through social media platforms, and were also hosting such objectionable content. After completing the investigation, CBI filed a charge sheet against the accused under various sections of the IT Act and Section 15(2) of the POCSO Act.

However, the trial court had acquitted the accused under Section 15(2) of the POCSO Act, saying that the children seen in the alleged obscene video had not been identified and the criteria required to determine their age were not fulfilled. Delhi High Court rejected this argument of the trial court and canceled its order. The court said that the process of framing charges should proceed on the basis of available evidence. After this decision, now a case will be filed against both the accused in the lower court under other sections including POCSO Act.
