Big relief to Umar Khalid from High Court, 3 days interim bail for mother’s surgery, strict conditions imposed
Tezzbuzz Desk- Umar Khalid has got a big relief from Delhi High Court. Umar Khalid, who has been in jail for the last five and a half years in the UAPA case related to the North-East Delhi riots, has been granted interim bail for three days by the court due to the serious surgery of his mother. This decision has been given purely on humanitarian grounds, so that he can be present in the hospital with his mother during this difficult time and provide emotional support to the family. The Court made it clear that this relief is in no way a comment on the merits of the case, but is merely a permission given for a limited period in view of the family circumstances.
The court has also imposed very strict conditions while granting bail. According to the order, Umar Khalid will have to stay only at his assigned residence and can go to the hospital only to meet his mother. Apart from this, participation in any other place, public meeting, political activity or media interaction is not allowed. The court has also directed that he will use only one mobile number all the time and his information will have to be made available to the investigating agency, so that his activities can be monitored.
The bail conditions also include a surety bond of ₹1 lakh, which will be mandatory to be deposited. It has also been ensured that the period of interim bail will not exceed three days and as soon as it ends, he will have to return to judicial custody. The court clearly indicated that this relief is being given in extraordinary circumstances and its scope is very limited.
Earlier, the lower court had rejected his petition saying that there were other members in his family who could take care of his mother. However, during the hearing in the Delhi High Court, his lawyer argued that the presence of a son at the time of the mother’s surgery is emotionally and medically important, keeping in mind the High Court granted this interim relief.
This case is part of the long-running UAPA case, in which Umar Khalid has been facing serious charges and has been in judicial custody for a long time. In such a situation, this three-day interim bail is being seen only as a humanitarian exception, and not as an indication of any legal relief or acquittal.
Overall, this order reflects the balanced approach of the Court, taking into account the sensitivity of a serious criminal case on the one hand and the humanitarian situation on the other. Now all eyes will be on how the legal process in this case moves forward after this three-day respite and what stand is taken in the next hearing in the court.
