New Delhi. Delhi’s Rouse Avenue Court has sentenced Bihar BJP MLA Raju Kumar Singh to four years in prison in the famous 2018 Harsh firing case. The court has also imposed a fine of Rs 25 lakh on the MLA, the amount of which will be given as compensation to the family of the deceased woman. Special Judge Vishal Gogane sentenced Raju Kumar Singh to four years’ simple imprisonment under Section 304 Part-II of the IPC and an additional two months’ imprisonment for violation of the Arms Act. The court also rejected the MLA’s demand for release on probation.

Bullet was fired at New Year party

This case pertains to the New Year party organized in the year 2018 at a farmhouse in Fatehpur Beri, Delhi. It is alleged that a woman named Archana Gupta was shot in the joyous firing during the celebration, due to which she died. Rouse Avenue Court said in its decision that joyous firing has become a serious social problem and many times it takes lives of people. On the basis of available evidence and statements of witnesses, the court held that the woman died due to the bullet fired by Raju Kumar Singh.

What will happen to the MLA’s membership?

Raju Kumar Singh’s assembly membership is also under threat after he was sentenced to four years’ imprisonment. Under Section 8 of the Representation of the People Act, 1951, if an MP or MLA is sentenced to two years or more, his membership ceases with immediate effect. However, if the High Court or the Supreme Court stays their conviction, their membership may be saved. Mere grant of bail or suspension of sentence does not end the disqualification from membership.
