Bombay High Court, in irritation, fixed the date of contempt case of 90 year old man in the year 2046.

Bombay Court has fixed the next date of 2046 for a 90 year old man. That means after 20 years. Will the elderly be in a position to go to court by the time the next date comes? Actually, the Bombay High Court has given this decision with irritation. This is a very unusual and strict verdict in a 9-year-old defamation case filed by an elderly woman. The court postponed this case till 2046 because the court felt that this case is an ego battle between two elders, due to which the valuable time of the court is being wasted. Therefore this case will not be heard for the next 20 years.

Justice Jitendra Jain clearly wrote in the order given on April 28, 2026, ‘This is one of those cases in which the ego battle between the parties at the last stage of their life is jamming the court system. Due to this, we do not get the opportunity to hear those important matters which are really of priority.

The court further said that since the petitioners are senior citizens or super senior citizens, this case will not be given any priority. It was clearly written in the order, ‘This matter should be listed after 2046.’ Under no circumstances will he be given priority on the basis of being a senior citizen. It is clearly said that this case will never be taken up for hearing before 2046.

The dispute started from the 2015 annual general meeting at Shyam Co-operative Housing Society. The society had passed a resolution to expel two women – Tariniben Desai, aged about 90, and another woman – from the society. These women filed a case in the court in 2017, terming the society’s notice, letter and proposal as defamatory and sought compensation of Rs 20 crore. He alleged that these letters had caused him mental distress.

The court tried to reach a compromise several times earlier. It was once said that the matter could be resolved if the society apologized unconditionally, but 90-year-old Tariniben Desai was not ready to accept the apology and remained adamant on taking the case forward. When the case came up for hearing on March 27, 2025, neither the women nor their lawyers came to the court. The court had given a strict warning. Now on 28 April 2026, Justice Jitendra Jain froze the entire case for 20 years. The court clearly said, ‘I do not want to say anything more on this matter, just that it should not be raised for the next 20 years.’

The Court believes that due to petty egos and personal disputes, the Court’s time is taken away from serious cases in which there are major issues related to life, property or rights of the common people. This decision is being said to be the result of the increasing irritation of the court, where time is wasted for years on small disputes. This news has become a topic of discussion in the entire country. Many people are praising this decision of the court, while some are calling it very strict.
