Giving a big relief to Bollywood actress Preity Zinta, Bombay High Court has given strict instructions to Meta, Google and other social media platforms and websites. The court has clearly said that all AI-generated deepfake videos and tampered digital content that violate Preity Zinta’s personal rights should be removed immediately. Along with this, the court also emphasized that these platforms themselves should step forward and stop such misuse. This order of the High Court has come on the petition of Preity Zinta, in which she had demanded removal of objectionable content which harms her image, reputation and copyright.
Direct violation of fundamental rights
Justice Madhav J. is hearing the case. Jamdar’s single-judge bench said, ‘Looking at the facts and evidence presented in the petition, it is clear that the deepfake content created by tampering with Preity Zinta’s image, photographs and videos has seriously violated her personality rights, publicity rights and moral rights. These rights are linked to Article 19 (1) (A) (freedom of speech and expression) and Article 21 (right to live with dignity and personal liberty) of the Constitution.
The court accepted that it had strong grounds to grant interim relief to the actress.
Court bluntly tells social media companies
During the hearing, Justice Jamdar slammed Meta and other platforms and orally said, ‘Being an international organization, you should be more concerned about the fact that your platform is being misused in this way.’
If you yourself start taking action on such matters, these criminals will get scared and this will only increase your credibility. Otherwise, you are also becoming a partner in hurting the fundamental rights of the citizens of the country.
What are the arguments of Preity Zinta’s lawyer?
Senior advocate Venkatesh Dhond, appearing for Preity Zinta, argued that many online platforms, websites and unknown people have created deepfake videos, memes, morphed photos and AI-generated chatbot personas of the actress.
He said that it is completely wrong to use Preity Zinta’s name or face commercially without her consent. This is not only hurting their reputation, but their rights under the ‘Copyright Act’ are also being violated.
Meta’s side and court’s instructions
Meta’s lawyer told the court that he had no objection to removing the links given in the complaint. However, citing a practical problem, he said that if in future the actress demands removal of any link which also includes some real photographs, then it may be a little difficult. In such a situation, they will convey their objection to Preity Zinta and her legal team.
On this, the bench said that both the parties can approach the High Court again if needed in future. Also, Justice Jamdar reminded that under Rule 3 of the IT Rules, 2021, there is already a provision for social media companies to exercise caution and responsibility.
There are many more big stars in the queue
Preity Zinta is not the only celebrity to approach the Bombay High Court to save her reputation and rights. In the last two years, the court has given similar relief to many other celebrities, including Kartik Aryan, Akshay Kumar and Sunil Shetty, Shatrughan Sinha and Shilpa Shetty, veteran singer late Asha Bhosle and singer Arijit Singh.
