Bulldozers will run on 143 houses in Shalimar Bagh, Delhi High Court’s ultimatum to vacate the houses by May 30
New Delhi: Delhi High Court has given a big order to widen the main road of Shalimar Bagh village. The court has given instructions to demolish 143 houses, in which about 157 families are living. The court has given clear instructions to the Delhi government to remove the illegal constructions to widen the road by 30 meters. The court bench has given time till May 30 to the affected families to vacate the houses. The court said in its order that road widening is necessary keeping in mind public interest and ease of traffic.
A bench of Justice Pratibha M Singh and Justice Madhu Jain heard all the parties, local residents and government departments in detail during the hearing. The court found that the landlord failed to produce valid documents in support of his construction. At the same time, other departments including Delhi Development Authority proved in the court that all these houses were built illegally on government land. The court also said that these buildings have been erected illegally up to five to six floors and occupy about 24 meters of land. In its order, the court also expressed concern over the poor condition of the area. According to the court, the road has become so narrow that even vehicles of essential services like ambulance, fire brigade and school bus are not able to pass easily, due to which jam situation often persists. The court clarified that to improve the situation and comply with Delhi Master Plan-2021, it is mandatory to widen this road by 30 meters. In view of this, instructions have been given to remove illegal constructions.
The bench said in its order that this illegal construction has been done on Max Road, Road No. 320 of Shalimar Bagh village (Hyderpur village). This route connects to the Ring Road (Mukarba Chowk) and is very important from the traffic point of view. The court said that in the survey conducted by the District Officer of the concerned area, 143 houses have been identified in the 670 meter long stretch, in which 157 families live. A total of about 750 people live in these houses. During the hearing, it also emerged that the landlords failed to produce valid documents, while other departments including the Delhi Development Authority proved that the constructions were done illegally on government land. Many buildings have five to six floors and occupy about 24 meters of land.
The land was acquired in 1980
During the hearing in the court, local residents had challenged the eviction notice issued by the government. The court asked the landlords to produce valid documents of ownership, but no concrete documents could be produced. At the same time, Delhi Development Authority (DDA) told the court that this land was acquired in the year 1980 itself. After this, this area was to be developed in a planned manner under various master plans, but people did illegal construction not only on the roadside but also on the drain adjacent to it.
‘Encroachment is being removed from only 10 meters’
During the hearing, advocate Dheeraj Singh, appearing for the government, told the court that the administration has adopted a flexible stance in this matter. He said that at present the road is being widened to 30 meters as per the prescribed standards by removing illegal encroachment from only about 10 and a half meter area. Whereas in reality about 24 meters of land is under illegal occupation. If the entire encroachment was removed, thousands of families could be affected and rendered homeless.
Major projects proposed in the area
Along with road widening, many major development works are proposed in this area. Construction of Mini Secretariat, the work of which is likely to start soon. Land identified for two shopping malls, map approved. Development of “Shalimar Place”, which will be designed on the lines of Bharat Mandapam, where big events will be organized. Officials believe that these projects will lead to rapid development of the area and strengthen the infrastructure.
