The Indian National Congress has approached the Supreme Court to oppose the petitions challenging the provisions of the Places of Worship (Special Provisions) Act, 1991. The party fears that any change in the Act could jeopardize the communal harmony and secular fabric of India.
The Congress has filed an intervention application in the public interest litigation (PIL) filed by BJP leader and lawyer Ashwini Kumar Upadhyay against the constitutional validity of the Act. The political party said in the application, “The applicant wishes to intervene in this case to emphasize the constitutional and social importance of POWA, as it fears that any change in it would jeopardize the communal harmony and secular fabric of India.” which may threaten the sovereignty and integrity of the nation.”
The Congress further said that it is committed to the principles of secularism and had played a key role in making the law when the party and the Janata Dal Party were in majority in the Lok Sabha. Since the applicant, through its elected members, was instrumental in introducing and passing POWA Therefore, the applicant may be allowed to intervene and defend the legal validity of the passage of POWA.
Congress has alleged that the Places of Worship Act is necessary for communal harmony and cordial relations among all communities in the country. Upadhyay's petition has been filed with ulterior and dubious motives.
