Shock to former BJP MLA Kuldeep Sengar from Delhi High Court, refusal to increase bail, said- surrender first

New Delhi. Delhi High Court on Friday refused to extend the medical bail of former BJP MLA Kuldeep Singh Sengar. Due to the separation of one of the judges hearing the case, the next hearing of the case in the court will be on January 27. The former MLA is on interim bail till January 20 on medical grounds. A request has been made on his behalf that his bail period should be extended due to the cataract surgery to be conducted at AIIMS on January 24.

However, when the hearing of the case started today, Justice Dharmesh Sharma recused himself from hearing the case. Kuldeep Singh Sengar's fresh petition in the Unnao rape case was listed for hearing before the bench of Justice Pratibha Singh and Justice Dharmesh Sharma, but the hearing could not begin.

Justice Sharma himself had given the decision

During the hearing, it came to light that Justice Dharmesh Sharma had given the verdict in which former MLA Sengar was found guilty in the rape case and he was sentenced to jail. Therefore, Justice Dharmesh Sharma recused himself from the bail related matter. Justice Pratibha Singh said that considering the verdict, the matter should be listed before another bench, in which Justice Dharmesh Sharma should not be a part.

Sengar should surrender first: Court

After this, the lawyer of expelled Bharatiya Janata Party (BJP) leader Kuldeep Sengar insisted on extending the period of medical bail and said that his eye operation is to be done on January 24. AIIMS has given the date. Justice Pratibha Singh rejected the request of Kuldeep Sengar and said that you surrender, then we will consider this application. We have given you enough discount. We can't just keep compromising.

Actually, the medical bail of Kuldeep Singh Sengar is ending on January 20. Now the High Court will hold the next hearing in the case on January 27. Sengar on Thursday requested the Delhi High Court to suspend the 10-year jail sentence given to him in the case of custodial death of Unnao rape victim's father. Sengar's plea for relief was filed on the ground that his appeal against the conviction and sentence was yet to be decided by the High Court, even though he had already spent a considerable amount of time in jail.

On interim bail till January 20

The former MLA is on interim bail till January 20 on medical grounds. Sengar also requested that his bail be extended due to his cataract surgery to be performed at AIIMS on January 24. Sengar, a BJP leader, was convicted of raping the minor victim and was sentenced to life imprisonment on December 20, 2019. In 2017, Sengar allegedly kidnapped and raped the victim. The victim was a minor when the incident occurred.
