Delhi High Court gives big relief to DU in PM Modi’s degree case, gives additional time of three weeks to the university

New Delhi. Delhi High Court on Tuesday gave a big relief to Delhi University (DU) in the ongoing case regarding disclosure of information related to the educational degree of Prime Minister Narendra Modi. The court gave the university three weeks’ additional time to file its objection to the delay in filing the appeal.

Chief Justice D.K. A division bench of Chief Justice DK Upadhyay and Justice Tejas Karia said, as prayed, three weeks’ time is given to file objections to the application regarding condonation of delay. The next hearing of the case will be on April 27.

Solicitor General’s stand on behalf of DU

Solicitor General Tushar Mehta, appearing for Delhi University, argued in the court that there is nothing concrete in this entire matter and it is being taken forward only to create sensation. He sought time to file a reply on the merits of the case along with the delay in the appeal.

Appellants’ argument: delay is minor

Senior counsel appearing for the appellants told the court that despite almost two and a half months having passed, DU has not filed any objection to the delay. He said that this delay is only 15 to 45 days, which can be easily condoned by the court. The lawyer also demanded that if Delhi University wants to respond to the main appeal, then the court should issue a formal notice. Solicitor General Mehta objected to this and said that issuing notice cannot be done just to create sensation.

What is the whole matter?

This appeal has been filed against the decision of the single judge of Delhi High Court, which had canceled the order of the Central Information Commission (CIC) on August 25, 2025, in which it was directed to make public the information related to the graduation degree of Prime Minister Narendra Modi. The appellants include RTI activist Neeraj, Aam Aadmi Party (AAP) leader Sanjay Singh and advocate Mohammad Irshad.

Important decision of single judge

It is noteworthy that the single judge had said in his decision that all the personal information of a person cannot be made public merely because he holds a public office. The court clearly said that the purpose of RTI Act is to bring transparency in government functioning, and not to provide material for sensationalism. The court had also remarked that if educational qualification had been mandatory for a public post, the situation might have been different. On this basis, CIC’s stand was said to be completely wrong. In the same decision, Delhi High Court had also canceled the order of CIC, in which instructions were given to make the class 10 and 12 records of former Union Minister Smriti Irani available from CBSE.
