Delhi High Court’s order: Dairy colonies will have to be relocated, status report sought from MCD

Delhi High Court has adopted a strict stance on the issue of relocating all the dairy colonies present in the national capital. The court on Wednesday directed the Municipal Corporation of Delhi (MCD) to file a detailed status report. The court said that the report should contain complete details of the policy under which the dairies are to be shifted, along with what conditions have been fixed for the transfer. Apart from this, the court has also sought information from the MCD as to how many licensed dairies are operating in the capital and how many are illegal (unauthorized) dairies.

A bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia ordered DUSIB to file an affidavit within six weeks. The court said that the board should present detailed information related to the status, facilities and rehabilitation of dairy colonies. The court is conducting this hearing on the petition of petitioner Sunaina Sibal, in which the poor condition of the dairies of the capital and the environmental and health related issues have been raised.

Condition of 9 designated dairy colonies is bad

Earlier in the report of the Court Commissioner, it was stated that the condition of all the nine designated dairy colonies of the capital is very bad. These include. Kakrola Dairy, Goela Dairy, Nangli Shakrawati Dairy, Jharauda Dairy, Bhalswa Dairy, Ghazipur Dairy, Shahbad Daulatpur Dairy, Madanpur Khadar Dairy, Masoodpur Dairy. According to the report, there is a serious lack of cleanliness, basic facilities and environmental standards in these colonies, leading to increasing pollution and health hazards in the surrounding areas.

The court expressed concern that large-scale construction has taken place in many dairy colonies and they have become rapidly urbanized. The counsel appearing for the petitioner said that there is no provision of grazing land in these colonies and the dairy plot holders keep the cattle confined in very poor and cruel conditions, due to which both animal welfare and the environment are being affected. During the hearing, the petitioner told the court that despite clear instructions of the High Court, till now no dairy colony has been shifted to another place.

In response, Municipal Corporation of Delhi (MCD) standing counsel Manu Chaturvedi told the court that as per the plan, the dairy colonies are to be shifted to the outskirts of the city and for this the cooperation of the neighboring states will also be necessary. He said that as a pilot project, it has been decided to shift Ghazipur and Bhalswa dairies located near the landfill site to Goela Dairy.

During the hearing, it was told by Delhi Municipal Corporation that in view of the problem of large scale accumulation of cow dung in these dairy areas, biogas plant has been installed in Goela Dairy and other necessary arrangements are also being made. At present the conditions related to shifting are being finalized.

Dairy owners’ side

The counsel appearing for the Bhalswa dairy owners told the court that they had no objection to the transfer, but the demands related to rehabilitation should also be considered. On this, the court said that the concerned authorities should take decisions thoughtfully on all aspects, so that the dairy operators can also get proper arrangements.
