Delhi High Court is strict on the demolition of DDA in Rajokri, said- ‘Can’t carry out demolition without hearing’
Delhi High Court has given big relief to many farmhouse owners amid the ongoing encroachment removal campaign in Rajokri village of Delhi. The court has directed to maintain the status quo during the hearing of the case and has provided interim protection to the affected parties. The case pertains to the anti-encroachment operation being conducted by the DDA around a stormwater drain in Rajokri area. The DDA says the drain and its adjacent land have been encroached upon, while the farmhouse owners have challenged this action in court.
During the hearing, the High Court said that the matter is currently under judicial investigation, hence the status quo should be maintained until the court takes a detailed consideration of it. The petitioners say that large portions of their properties including boundary walls, guard rooms, servant quarters and other constructions were demolished without any prior show cause notice. They allege that this action was taken without giving them an opportunity of being heard, which is against the principles of natural justice.

In the matter related to the action of removing encroachment, the court has made important comments and directed to maintain the status quo for the time being. This order was given after a hearing before the bench of Justice Amit Sharma on June 3, 2026. The case pertains to a demolition drive carried out by the DDA, with several farmhouse owners challenging the action. During the hearing, the court observed that the notice on the basis of which the DDA was acting did not clearly mention any separate show-cause notice in which the proposal or basis for the demolition action was explained in detail.
The petitioners say that these structures have been in existence for years, even decades, and were developed on the basis of valid permission. They also argue that the Supreme Court guidelines were not followed during the demolition action. During the hearing, the bench considered the matter under the ambit of judicial investigation and directed to maintain the status quo for the time being. The court also said that until the detailed hearing of the case is completed, the concerned departments should refrain from taking any new action in this area.
