Dispute over broken slippers led to arrest, non-bailable warrant on showroom manager
Not returning the broken slippers and ignoring the order of the Consumer Forum cost the Liberty showroom manager dearly. Consumer Forum has issued a non-bailable warrant against showroom manager Usman. The forum has Police A letter has been written to the Superintendent and instructions have been given to arrest the manager by serving the warrant by January 2 and present him before the forum.
Arif, a resident of Batsganj in Sitapur district of Uttar Pradesh, had purchased slippers worth Rs 1700 from the Liberty showroom located near the transport intersection of the city on 10 May 2022. The showroom manager had promised to give a warranty of six months, but the slippers started breaking in just a month.
On complaining, there was first delay and later, despite keeping the slippers, new slippers were not given, due to which the matter reached the Consumer Forum and later on it led to the issue of (Consumer Forum Non Bailable Warrant).
Frustrated after the continuous rounds, Arif filed a suit in the Consumer Forum on 17 October 2022. Despite the issue of notice, the showroom manager neither appeared in the forum nor filed any reply.
After this, on January 8, 2024, the Forum passed an order to return the price of slippers along with paying Rs 2500 for mental torture and Rs 5000 as litigation expenses, but this order was also not complied with, which directly became the basis for issuing (Consumer Forum Non Bailable Warrant).
Consumer Forum Chairman Justice Abhimanyu Lal Srivastava considered the disobedience of the order as serious and said that ignoring the instructions of the Consumer Forum is not tolerable.
Under the Consumer Protection Act, a compulsory non-bailable warrant (Consumer Forum Non Bailable Warrant) has been issued, so that the order can be ensured.
The forum has also made it clear that if the warrant is not served within the stipulated time frame, further more stringent action can be taken. Considering the entire matter as a serious example related to consumer rights, the Forum has called the Consumer Forum Non Bailable Warrant as a necessary step.
