Downloading and possessing child pornography is a crime

Supreme Court decision: The Supreme Court has clarified that downloading and possessing child pornography material is a crime in India. This decision has come overturning the previous decision of the Madras High Court, which said that merely watching child porn is not a crime. The Supreme Court also suggested that Parliament should amend the POCSO Act to replace the term 'child pornography' with 'child sexual abuse and degrading material'.

Meanwhile, all courts have been instructed not to use the term 'child pornography'. The Madras High Court's decision stated that watching child porn alone is not a crime, but the Supreme Court declared it against the law. Taking cognizance of the hearing in this case, the Supreme Court said that punitive action is required in such cases, so that the society can be made aware of this issue.
