‘Either surrender yourself or else…’ The toughest and biggest decision of the Supreme Court in the Raja Raghuvanshi murder case.

The troubles of Sonam Raghuvanshi, the main accused in Indore’s famous Raja Raghuvanshi murder case and wife of the deceased, have once again increased a lot. Hearing the appeal of the Meghalaya government, the Supreme Court has canceled Sonam’s bail and has given strict orders to her to surrender before the court within the next 3 weeks.

This entire case is related to the sensational murder of Indore’s transport businessman Raja Raghuvanshi during his honeymoon, in which his wife Sonam Raghuvanshi is the main accused. The Meghalaya government had challenged the decision of the High Court in the Supreme Court, under which Sonam was granted bail. Now the Supreme Court has given clear instructions that the trial of this entire case should be completed within the next 6 months. The court has also said that if the trial is not completed in 6 months, then accused Sonam can file her bail petition again, but at present she will have to surrender within three weeks.

What was the old decision and controversy of Meghalaya High Court?

Earlier, on June 30, the Meghalaya High Court had upheld the bail granted by the lower court to Sonam Raghuvanshi, the main accused in the Raja Raghuvanshi murder case, and had rejected the petition of the Meghalaya government. The High Court believed that there were some technical flaws in the process of Sonam’s arrest. The Meghalaya government had approached the Supreme Court against this decision, where the government has now got a big relief.

During the hearing on Tuesday, the Supreme Court had given two clear options to Sonam Raghuvanshi’s lawyer and asked whether Sonam would surrender on her own will or the court would give its final decision on canceling her bail. On the other hand, while filing her reply in the Supreme Court, accused Sonam had declared herself completely innocent and claimed that she has been falsely implicated in this case. His lawyers argued that the entire case rests only on circumstantial evidence, hence he cannot be considered guilty on the basis of allegations alone.

Strong arguments and allegations of Solicitor General Tushar Mehta

Solicitor General (SG) Tushar Mehta, appearing for the Meghalaya government, made strong arguments in the Supreme Court, saying that there was only a small technical mistake in typing the number of a legal section in the documents, but a murder accused should not be granted bail on the basis of such a minor typing mistake. Tushar Mehta also expressed apprehension to the court that if Sonam’s bail is not cancelled, there is a big danger of her absconding from the country.

Describing the brutality of the incident in the court, SG Tushar Mehta told that Sonam was married to Raja Raghuvanshi and soon after the marriage, both of them had gone to Meghalaya for honeymoon. It is alleged that Sonam lured her husband to a secluded place in the hills, while three other men hired by her lover were continuously following them. After this, the husband was murdered in a planned manner and the body was thrown into a ditch. Investigation revealed that the husband did not die by falling into the ditch, rather he was first brutally murdered and then the body was thrown, after which Sonam fled from the spot.

Discussion on arrest memo and omission of legal sections

The investigation also revealed that the three people who had helped Sonam in this conspiracy were present at a particular place, after which they were arrested. According to the records, Sonam’s boyfriend had advised her that it would be safer for her to surrender before the police, after which she reached Ghazipur and surrendered.

Tushar Mehta requested the court to please see the arrest memo, in which he had given the name of his brother for contact. During the paperwork, Section 403 was mistakenly mentioned instead of the serious crime of murder (Section 103), on the basis of which the accused party was trying to take advantage. At present, after this strict order of the Supreme Court, Sonam Raghuvanshi’s troubles have increased again.
