Epstein was found dead in 2019 while awaiting trial on sex trafficking charges. The New York Medical Examiner’s Office ruled his death a suicide by hanging. Although Dr. Baden did not conduct the postmortem himself, he was present as an observer.

He says that at that time both he and the medical examiner agreed that more information was needed to determine the cause and manner of death.

In 2019, Baden described his professional findings as “unclear” (inconclusive). But five days after the death certificate was issued, the then Chief Medical Examiner Dr. Barbara Sampson declared it a suicide. Baden told The Telegraph that Sampson was not present during the post-mortem.

The official postmortem report recorded three fractures in Epstein’s neck. One in the left hyoid bone and two in the thyroid cartilage. Dr. Baden said that in his career of 50 years he had never seen three fractures of the neck in any case of hanging by suicide, even in cases of death of prisoners in New York jails. In August 2019, he told Fox News, “The evidence points to murder rather than suicide.”

A 2023 US Justice Department report reported that Epstein’s cell contained extra blankets, sheets, and clothing, some of which were torn and looked like noose. Routine cell searches were neither conducted properly nor were their records maintained.

August 9, 2019, a day before his death – Epstein’s cellmate was transferred to another location and no new inmate was appointed in his place. The required 30-minute wellness checks following the lockdown around 8 p.m. were not conducted until about 10:40 p.m., CBS reported, citing newly released video logs. The staff later manipulated the records to show that the rounds had been completed. The next morning two guards found him hanging from the upper bunk.
