Family Court Rules: Lawyers and judges should not come in uniform, Justice Surya Kant’s big instructions regarding family court
News India Live, Digital Desk: As soon as the name of the courts comes up, a picture of black coat, white band and a serious atmosphere emerges in the mind. But now the scenario of Family Court is going to change. Senior Supreme Court judge Justice Surya Kant has made an important comment saying that judges and lawyers should not come in their official uniform in the family court. He stressed that the atmosphere of these courts should not be scary but should be like home. Why was the advice given to come ‘without uniform’? Justice Surya Kant told during a program that the cases coming in the family court are emotional and children are also involved in them. Psychological impact on children: When small children see judges and lawyers in black uniforms in the strict and formal environment of the court, they get scared. This has a bad effect on their mental condition. Trying to reduce stress: According to Justice Surya Kant, if the judge and lawyer are in ordinary clothes, then an environment of dialogue will be created between the parties (husband and wife) and it will be easier to resolve the disputes. On making the family court a ‘counselling centre’, Justice Surya Kant said that the main objective of the family court should not be to win the legal battle, but to unite the broken families. Friendly atmosphere: Judges The court should play the role of a mediator rather than a judge. Confidentiality and sensitivity: It is important to be sensitive during the hearing of family disputes, so that the dignity of relationships is maintained. Will the picture of the courts change? This is not the first time that uniforms have been discussed in the judiciary. Police and lawyers in juvenile homes and Juvenile Justice Boards are also advised to remain without uniform. With this initiative of Justice Surya Kant, it is hoped that in the coming times, family courts will be made more ‘child-friendly’ and less stressful.
