‘FIR should be registered against Sonia Gandhi…’, in 45 year old case, the person knocked on the door of the court, said – he had done this illegal work even before taking citizenship.

A person has approached Delhi’s Rouse Avenue Court to file a case of vote theft against former Congress President and Rajya Sabha MP Sonia Gandhi. In his application, the person has challenged the order of the Magistrate Court in which it had clearly refused to give instructions to register an FIR against Sonia Gandhi. It has been alleged in the application that Sonia Gandhi’s name was added to the voter list three years before she took Indian citizenship.

The case came up before Special Judge (PC Act) Vishal Gogane of Rouse Avenue Court on Friday. The judge has ordered to list it for consideration on December 9. This criminal revision application has been filed by a person named Vikas Tripathi. In his petition, Tripathi has challenged the September 11 order of Additional Chief Judicial Magistrate (ACMM) Vaibhav Chaurasia.

Sonia became a citizen of India in 1983

Tripathi has alleged that Sonia Gandhi’s name was included in the voter list of New Delhi constituency in 1980, even though she had become a citizen of India in April 1983. Giving other details in the application, Tripathi has alleged that Sonia Gandhi’s name was first included in the voter list in 1980, then it was removed in 1982. After this, her name was again included in the voter list in 1983, when she officially became a citizen of India.

Must have submitted some fake documents?

Tripathi’s lawyers have alleged that his name being included in the voter list in 1980 means that he had submitted some fake documents then. According to lawyers, this is a case which shows that a cognizable offense has been committed. Earlier in September, Judge Chaurasia had rejected the petition saying that the court cannot conduct such an investigation as it would wrongly infringe on the areas entrusted to constitutional authorities and would be a violation of Article 329 of the Constitution of India.
