Akhlaq Lynching Case: The search for the real murderer remained incomplete during Yogi Raj, innocent people were made ‘accused’!

The judge rejected the defense’s petition, calling it legally baseless. Also said that the case will continue further.”
It’s like finding a needle in a haystack
All these absurd things were said by Dr. A.P. Singh, a senior criminal and well-known defense lawyer of the Supreme Court on Wednesday. He was talking exclusively to the Editor Crime Investigation of Read Hindi in New Delhi. According to him, according to me, neither before nor till now the real accused have been arrested in this shameful incident. The people who have been arrested as illegitimate accused by the investigating agency are the real accused. I doubt this too. Because at the place where that gruesome murder was committed in the dark of night, there was no proper arrangement of CCTV cameras. Nor are there any other technical means by which it can be definitively determined who were actually involved in the murder of Mohammad Akhlaq. In such a situation, it seems that reaching out to the real culprits in the Akhlaq lynching case must have been like finding a needle in a haystack for the investigating agency.

This is the same Akhlaq lynching incident that took place in Bisahada village (Dadri) of Greater Noida, the hi-tech city of UP adjacent to Delhi, in which Mohammad Akhlaq was surrounded and killed by the mob at night. The mob’s argument was that Akhlaq and his family members had allegedly slaughtered a cow calf stolen from the area and consumed its meat. The case took a political twist when the investigating agency made Vishal Rana, son of a local leader of the Bharatiya Janata Party, and one of his close relatives accused. As soon as the names of people belonging to big families came to light in the lynching, it was feared that the victim’s family would hardly get justice in this case.
The people made accused are not innocent…!
Now there is an uproar when the UP government filed an application in the trial court this year i.e. in October 2025 to withdraw the charges against all the accused in the case in the concerned court. But the court rejected the arguments of the defense and passed an order to continue the case. Dr. A.P. Singh, senior criminal lawyer of the Supreme Court and an advocate of the Nirbhaya murder accused who were hanged in Delhi’s Tihar Jail on March 20, 2020, says, “Indian law says that a hundred criminals should be let go but one innocent person should not be made a criminal. In the times to come, from what I have seen of this case so far, it seems that the 18-19 people whom the investigating agency has arrested.” They have been roaming around as accused for the last 15 years because I don’t think they are real criminals.
Such cases are very complex and sensitive.
You are saying that the accused made accused by the investigating agency in the Mohammed Akhlaq lynching case is not the real culprit. Then the question is bound to arise that in future, will the culprits of that brutal murder never be punished? In response to the question, the senior criminal lawyer said, “Courts do not conduct media trials. The judge has to proceed after looking at the witnesses and evidence present on the case file. This is why only the files and documents filed by the investigating agency will get anyone declared a criminal. It is not so. These documents, witnesses and evidence have to be proved in front of the court by the investigating agency itself. I think the Mohammad Akhlaq murder case is a very complicated case.” Taking such a sensitive and high profile case to court, which has been conducted very hastily, proves fatal from the point of view of justice.
