HC grants anticipatory bail to engineering student in finger chewing case

Madhya Pradesh High Court today gave an important decision in the case of finger chewing. The single bench of Justice Maninder Singh Bhatti granted anticipatory bail to the accused engineering student, finding the tooth not in the category of a weapon.

The student approached the High Court

Actually, the police had registered a case of biting an advocate's finger during a land dispute. In this case, to avoid arrest, the engineering student approached the High Court. Senior advocate Manish Dutt, appearing for the applicant Utsav Rai, said that in a case of this nature, the maximum that can be imposed is Section 325, which is bailable. The police want to arrest him under Section 326, hence anticipatory bail is required.

In opposition to the anticipatory bail application, the government lawyer said that on June 10, 2024, there was a dispute between two parties regarding the possession of a plot of land near Ranganath police post under Katni district. During this, both the sides started scuffling.

What argument did the government lawyer give?

The complaining advocate had caught hold of Utsav's face from behind. Other people were also catching him and beating him. During this time the applicant not only bit the advocate's finger but also chewed it and swallowed it. Anticipatory bail should not be given in such a gruesome case.

The applicant said – could not think of anything to save himself

On behalf of the applicant, senior advocate Manish Dutt argued that in the difficult situation that had arisen on the spot, the applicant had chewed the advocate's finger with his teeth when he could not think of any other way to save himself. After the incident, the injured advocate was taken to the hospital, while Utsav was caught by the police.
An offense under unfair section was also committed against the festival. Actually celebration is not a criminal. He had bitten with teeth and teeth do not fall in the category of weapons, but the section imposed can be imposed only in case of attack with a sharp weapon.
