Himanta Biswa Sarma Case: SC refuses to hear the petition against Himanta Biswa Sarma, said
Supreme Court of Assam Chief Minister Himanta Vishwa Sharma Has refused to hear the petition filed against (Himanta Biswa Sarma Case). A bench headed by Chief Justice of India Surya Kant made a clear observation that the Supreme Court is not a “playground to settle” any case. The court advised the petitioner to first approach the High Court.
During the hearing, the Supreme Court said that when under the Constitution the High Court has full power to pass orders in any case, then there is no justification for coming directly to the Supreme Court. The bench told the petitioner that he should have faith in the judicial system. The court also directed the Gauhati High Court that if the petition is filed there, the case should be heard expeditiously.
In this case, senior advocate Abhishek Manu Singhvi argued that this is not just a case of one state but of statements related to many states (Himanta Biswa Sarma Case). He said that apart from Assam, controversial statements have also been made in Jharkhand and another state. On this the CJI bluntly said that first go to the High Court, the Supreme Court will hear later.
It was alleged in the petition that Chief Minister Himanta Vishwa Sharma has made objectionable comments against the Muslim community and an FIR should be registered against him and an SIT investigation should be conducted. This petition was filed by Communist Party of India leader Annie Raja.
The matter became more heated when a poster and video released by Assam BJP went viral on social media (Himanta Biswa Sarma Case), in which a character similar to Himanta Vishwa Sharma was seen pointing a gun at people wearing a Muslim cap and it was written along with it – “No mercy.” After the controversy escalated, the party had to remove this video from its official handle.
After the latest stand of the Supreme Court, it has now become clear that the legal battle of this entire controversy against Himanta Vishwa Sharma will be fought in the Gauhati High Court only.
