How long can Nitish Kumar remain Chief Minister?

There are clear rules regarding the post of Chief Minister in the Indian Constitution. Under Article 164(1) of the Constitution, the Governor appoints the Chief Minister. There is a provision in Article 164(4) that even if a person is not a member of the Legislative Assembly or Legislative Council, he can still hold the post of Chief Minister for six months.

This means that even if Nitish Kumar leaves the membership of the Legislative Council and is elected to the Rajya Sabha, he can remain the Chief Minister for a maximum of six months i.e. 180 days. Within this period he will have to take membership of any House, otherwise it will be mandatory to leave the post.

This provision of the constitutional system has been made to maintain stability in such times, so that the functioning of the government is not suddenly affected.

What will be the next step in case of resignation?

If Nitish Kumar decides to resign from the post of Chief Minister before going to Rajya Sabha, then the entire process proceeds from the level of the Governor. After the resignation is accepted, the Governor can invite any other leader to form the new government.

Usually, in such a situation, a meeting of the legislative party of the ruling party or coalition takes place. In this meeting a new leader is selected, who is chosen as the leader of the legislative party. After this the Governor administers the oath of office to him as the Chief Minister.
