If toll tax is not paid, important work will get stuck! Government’s new rule will increase the difficulty for car drivers
Toll Tax Pending Rule: If toll tax is due on your vehicle, then negligence can prove costly. The Central Government has made a major change in the motor vehicle rules and made it clear that without paying the toll dues, many important government works related to the vehicle will not be carried out. This decision will directly impact crores of vehicle owners, especially those who travel on the highways daily.
The government has implemented the Central Motor Vehicles (Second Amendment) Rules, 2026. The main objective of these rules is to strengthen toll collection on National Highways, promote digital system and completely curb toll evasion.
What changed under the new rules?
According to the new rules, if toll tax is found outstanding on any vehicle, many important works related to it will be stopped.
- NOC will not be required to transfer the vehicle from one state to another.
- The fitness certificate of the vehicle will not be renewed.
- National permit will not be issued to commercial vehicles.
That means, if you ignore toll payment, your vehicle will not be considered legally fit to drive on the road.
What is the new definition of outstanding toll?
The government has now banned “unpaid user fees” A new definition has been set. According to this, if a vehicle passes through the toll plaza and the payment is not recorded in the electronic system, then that amount will be considered as direct toll dues. Be it technical fault of FASTag or payment not being made due to any other reason, the responsibility will be on the vehicle owner.
Now complete information will have to be given in the form also
It will now be mandatory to clarify in Form-28 (NOC form) to be filled for vehicle transfer that there is no toll outstanding on the vehicle. It is a matter of relief that this form can now be filled online also, which will make the process more transparent and faster than before.

Digital toll system will get a big boost
The government says that with these changes it will be easier to implement barrier-less toll system (MLFF – Multi Lane Free Flow) in future. With this, vehicles will be able to pass through the highway without stopping and toll will be automatically deducted. With these rules, NHAI will get transparency in toll collection, better technical control and more resources for maintenance and development of highways.
