The petition said that the trial court judge had committed a mistake in taking cognizance of the offense under Section 3 of PMLA. Petitioner Arvind Kejriwal said that prior sanction is required for prosecution under Section 197 (1) of CRPC, but the ED has not done so in his case. This is particularly significant because petitioner Arvind Kejriwal was the Chief Minister at the time of the alleged offence.

On November 12, Delhi High Court had sought reply to the petition filed by Arvind Kejriwal in which he had challenged the summons issued to him. Arvind Kejriwal is currently on bail in the ED and CBI case, and on March 21, the Supreme Court granted him bail. Currently all the leaders are on bail, but Kejriwal, former Delhi Deputy CM Manish Sisodia, AAP Rajya Sabha MP Sanjay Singh and party leader Vijay Nair also had to go to jail.
