Indian team's head coach got a big blow, Delhi Court rejected the old order of acquittal
Sports Desk: Ever since the head coach of the Indian team, Gautam Gambhir has been associated with the Indian team, the Indian team seems to be losing its credibility. As soon as he joined the Indian team, during the tenure of Gautam Gambhir, they lost the ODI series in Sri Lanka. A Delhi court has restarted the investigation into the case of alleged fraud with flat buyers involving former cricketer and current Indian cricket team head coach Gautam Gambhir. Special judge Vishal Gogane overturned a lower court's earlier decision acquitting Gambhir and said the verdict reflected “inadequate consideration” of the charges against him.
“These allegations also deserve further investigation into the role of Gautam Gambhir,” Judge Gogane said in the October 29 order. The case was initially filed against real estate firms Rudra Buildwell Realty Pvt Ltd, H R Infracity Pvt Ltd, U M Architecture and Contractors Ltd and Gambhir (who acted as both director and brand ambassador for the companies' joint venture) Which centered around claims of defrauding investors.
Gambhir had direct contact with investors
Judge Gogane said Gambhir was the only accused who had “direct contact with investors” as a brand ambassador. Despite his acquittal, the trial court judgment did not address his financial involvement with the company, which includes payment of Rs 6 crore to Rudra Buildwell Realty Pvt Ltd and receipt of Rs 4.85 crore in return.

“It is not made clear in the charge sheet whether the amounts paid back to him by Rudra had any connection with them or whether they were derived from money received from investors in the project in question,” the judge said. “Since the core of the allegations relate to the offense of fraud, it was necessary to clarify by the charge sheet as well as the impugned order whether any part of the defrauded amount had come into the hands of Gambhir.”
The court found that Gambhir had financial transactions with the company beyond his role as brand ambassador and that he was an additional director between June 29, 2011 and October 1, 2013. Thus, he was an incumbent when the project was advertised. The prosecution in this case has alleged that the complainants booked flats in the projects and paid between Rs 6 lakh and Rs 16 lakh after being lured by advertisements and brochures.
