Jharkhand News: Jharkhand CM Hemant Soren is determined to provide the tribals of the state their rights and empower them. The Jharkhand government on December 23 approved the formation of PESA rules — Panchayat Provisions (Extension to Scheduled Areas) Jharkhand Rules, 2025 — to empower the tribal communities of the state. Now, as soon as the notification is issued, the PESA Act will be implemented in the scheduled areas of the state. There will be 15 districts of the state under its scope.

Regarding this, the Jharkhand CM office made a post on ‘X’ and wrote that the PESA law will prove to be a milestone for the culture and tradition of the tribal society…Many congratulations to everyone.

What is PESA law?

The PESA law i.e. Panchayat (Extension to Scheduled Areas) Act, 1996 was brought because the general Panchayat law did not match the social structure, traditions and spirit of community ownership of the tribal society. The framers of the Constitution believed that decisions in tribal areas should not be taken from the top, but from the bottom up by the Gram Sabha. PESA gives legal form to this thinking.

What has changed in the PESA law?

Under the new rules, Gram Panchayats will get the statutory right to take important decisions in matters related to mining rights, land acquisition and forest land in their area. Gram Sabha will play a role in planning. Traditional village councils have been given authority. All Gram Sabhas will notify their traditions. In rural areas, the Gram Sabha will also have rights over the use of minor forest produce, local area development planning and water resources management.

How important is the PESA law?

In tribal areas, the center of governance will not be the district or the state, but the Gram Sabha. Consent of local gram sabhas will be mandatory before land acquisition for development works or mining projects, so that rural and tribal societies will be able to protect their natural resources themselves. There are scheduled areas in 10 states in India, namely Andhra Pradesh, Telangana, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Madhya Pradesh, Maharashtra, Odisha and Rajasthan.
