This case is in discussion because the victim narrated her story 11 years after the incident, on the basis of which the court has given this decision.
This incident is of the year 2013-14. At that time, the Dalit victim was a fifth class student and accused Subhash Kumar (57 years) used to give tuition to her. According to the investigation, being troubled by the repeated exploitation, the girl had stopped going for tuition, but due to fear she did not tell this to her family.

Now that girl is a medical student. In July 2024, while undergoing treatment for depression, he told the doctor about this old incident during his therapy. On the advice of the doctor, he contacted the police, after which an FIR was registered. After this, the police took action in this case and arrested the accused.

The victim told the court that due to this shock she often had panic attacks. When he met a friend’s father in his second year of college, old memories came alive and his condition worsened, after which he decided to seek treatment.

Fast-track court judge Anju Meera Birla has found Subhash Kumar guilty under various sections of the POCSO Act. The court said that the convict will have to serve 18 years of rigorous imprisonment. A fine of Rs 35,000 has also been imposed on him. If he does not pay the fine, he will have to spend additional 3.5 years in jail.

The court also accepted that the delay in filing the report was completely justified. According to the court, the victim remained silent due to mental shock and social situation, hence there is no reason to doubt her testimony.
