Kuldeep Sengar’s troubles may increase, CBI reaches SC against Delhi HC’s decision
New Delhi : In an important development related to the Unnao rape case, the Central Bureau of Investigation (CBI) has challenged in the Supreme Court the order of the Delhi High Court, in which the convict Kuldeep Singh Sengar was granted bail while suspending his sentence. This matter is not only important from the legal point of view, but also raises deep questions on the social and judicial system.
CBI’s petition in Supreme Court
CBI has filed a Special Leave Petition (SLP) in the Supreme Court on Friday, 16 December. Through this petition, the investigating agency has objected to the decision of the Delhi High Court, in which the sentence of Kuldeep Singh Sengar was temporarily stayed and he was given the benefit of bail. CBI says that this order of the High Court is not in accordance with the principles of justice in a case related to serious crime.
Delhi High Court order
A division bench of the Delhi High Court, comprising Justice Subramaniam Prasad and Justice Harish Vaidyanathan Shankar, suspended Sengar’s sentence and granted him bail. The court had given this relief with some conditions, which included paying a bail bond of Rs 15 lakh. After this decision of the High Court, this matter once again came into discussion, because it has been a very sensitive and discussed case.
sentencing and prejudgment
It is noteworthy that Kuldeep Singh Sengar was sentenced in a separate but related case in March 2020. This case was related to the custodial death of the victim’s father. The court had sentenced Sengar to 10 years of rigorous imprisonment in this case and also imposed a fine of Rs 10 lakh. Even before this, Sengar had been convicted in the Unnao rape case, which had created outrage across the country.
CBI’s objection and arguments
CBI believes that granting bail to a person guilty of such a serious crime gives a wrong message to the victim and the society. The agency argues that suspension of sentence in such cases weakens the seriousness of the justice process. On this basis, CBI has sought intervention from the Supreme Court, so that the High Court order can be reviewed.
further legal process
Now the stand of the Supreme Court in this matter is considered very important. The apex court will decide whether the decision of Delhi High Court will remain intact or the order will be changed accepting the arguments of CBI. This decision will not only impact this case, but can also impact the judicial approach in such sensitive cases in future.
Unnao rape case has already become an important chapter in the judicial history of the country and this petition of CBI once again raises the question as to what should be the limit of giving relief to the accused in serious crimes.
