Patna: Former Railway Minister Lalu Prasad Yadav and former Bihar CM Rabri Devi appeared in Delhi’s Rouse Avenue Court today in the land-for-jobs case. During this time, charges were formally framed against them. Lalu-Rabri have declared themselves innocent in this case. He said they would face trial. This case pertains to the alleged crime of providing Railway Group D jobs to candidates in exchange for land.

The court also said that unless an order allows video conferencing, the accused will have to appear in person. “Considering their age and health, the court has asked them to appear through video conferencing,” Misa Bharti said.
Charges were framed on January 9

On January 9, the Rouse Avenue court had directed framing of charges against Lalu Prasad Yadav, Rabri Devi, Tejashwi Yadav, Tej Pratap Yadav, Misa Bharti and other accused in the land-for-jobs scam case. While directing framing of charges, the special CBI court had said, “Prima facie, Lalu Prasad Yadav had used government jobs to acquire immovable property from job seekers through his family members,” the court further said. “Lalu Prasad Yadav and his family worked like a syndicate.” The court acquitted 52 accused, including Chief Personnel Officers (CPOs) and railway officials. Five accused died during the action. CBI had filed charge sheet against 103 accused. Charges were framed for offenses under the Criminal Conspiracy, Cheating and Prevention of Corruption Acts. The special judge said, “The charge sheet clearly shows the acquisition of land in exchange for jobs.”

Lalu called the allegations politically motivated

During the arguments, senior lawyer Maninder Singh, appearing for Lalu Prasad Yadav, said that the land-for-jobs case was politically motivated. He said, “There is no evidence that the candidates were given jobs in exchange for land. There are sale deeds which show that the land was purchased for money.” He further said, “Former Railway Minister Lalu Prasad Yadav had not made any recommendation for any candidate. No general manager has ever said that he No evidence was found from Lalu Prasad that any land was purchased without compensation.”
Rabri’s lawyer said- buying land is not a crime

Earlier, during the arguments on behalf of Rabri Devi, it was said, “Rabri Devi bought land and paid money for it. Buying land by taking money is not a crime. No benefit was given to any accused candidate. These transactions are not connected.” Instructions were given to impose common charges of criminal conspiracy, fraud and corruption against Mahajan and Prem Chand Gupta.

The court further said, “The court finds beyond a reasonable doubt that there was a major criminal conspiracy under the supervision of Mr. Lalu Prasad Yadav, in which the government job was used as a bargaining chip to acquire immovable properties from job seekers through his wife Rabri Devi, daughters Misa Bharti and Hema Yadav as well as sons Tejashwi Prasad Yadav and Tej Pratap Yadav.” The CBI had registered the case on May 18, 2022. And two chargesheets and two supplementary chargesheets were filed at different times. It is alleged that Group D jobs of Railways were given in exchange for pieces of land.
Appointment by misuse of officials: Court

The court said, “Many of the accused General Managers of Indian Railways prima facie appear to have made these appointments by misusing their authority to appoint Group D substitute people in the Railways.” The court said that the accused CPOs neither had the authority to appoint substitute people nor were they under the influence of the Railway Minister. The court ordered, “All the accused Chief Personnel Officers can be acquitted.”
