Law students with low attendance will not be able to give exams, Supreme Court stays Delhi High Court’s decision

Delhi. The Supreme Court has put an interim stay on the Delhi High Court order under which law students with poor attendance were allowed to appear in the examination.

A bench of Justice Vikram Nath and Justice Sandeep Mehta gave this order while issuing notice on a petition by the Bar Council of India (BCI) challenging the Delhi High Court’s directions on mandatory attendance for law students.

The court said in its order, “Issue notice and reply by July 21. In the meantime, the effect and operation of paragraph 249 of the impugned judgment will remain suspended. However, it will remain in force in future also.”

The bench made it clear that its directions would not prevent the High Court from taking independent decisions on similar matters relating to attendance requirements in cases pending before it.

The court said, “Where similar cases are pending on the issue of appearance, the High Court can take appropriate decisions.” The court also questioned why BCI did not challenge the High Court decision earlier.
