Family of soldier killed in road accident will get compensation of Rs 70 lakh, MACT order

Motor Accident Claims Tribunal in the capital Delhi (MACT) has given a big verdict in the case of a road accident that occurred in 2021. Holding the truck driver and truck owner guilty, the tribunal has ordered a compensation of Rs 69.61 lakh to the family of the deceased soldier. The tribunal in the case held that the accident was caused by careless driving. 53 year old soldier Bal Kishan had died in the accident. The court accepted that the responsibility of this accident lies with the truck driver and the vehicle owner. The tribunal has directed the insurance company to deposit a compensation amount of Rs 69.61 lakh with 9 percent annual interest to the family of the deceased. This amount has been decided keeping in mind the financial loss and future needs of the family.

The MACT of Saket district court, in its order dated February 20, 2025, said that the accident occurred due to the negligence of the truck driver. During investigation, blood stains were also found on the tire of the truck, which confirms the accident. Apart from this, the mechanical investigation report also revealed negligence on the part of the driver. The truck driver did not even appear in the court as a witness during the hearing. At the same time, the lawyers of the truck driver, truck owner and the insurance company tried to prove that the accident happened due to the fault of the deceased soldier Bal Kishan. However, the tribunal rejected this argument on the basis of available evidence and investigation report.

The tribunal has directed the insurance company to deposit a compensation amount of Rs 69.61 lakh with 9 percent annual interest to the family of the deceased. The court said that this amount has been decided keeping in mind the financial loss suffered by the family and future needs.

Anjani Mahajan, presiding officer of MACT, Saket district court, gave this order on 20 February 2025. The court said in its decision that the negligence of the truck driver was the main reason for the accident. During the investigation, blood marks were found on the tires of the truck and the mechanical inspection report also revealed negligence on the part of the driver. The truck driver did not even appear in the court as a witness during the hearing. At the same time, it was argued on behalf of the truck driver, vehicle owner and the insurance company that the accident happened due to the fault of the deceased and he was driving the motorcycle at high speed. However, the tribunal rejected these arguments based on the available evidence.

This claim petition was filed on behalf of the wife of deceased soldier Bal Kishan and his four children. The family told the court that at the time of the accident, Bal Kishan’s monthly income was Rs 67,534 and the entire family was dependent on his earnings. The family also mentioned financial difficulties. The tribunal has directed the insurance company to deposit a compensation amount of Rs 69.61 lakh with 9 percent annual interest to the family of the deceased. In this case, the court has fixed the next hearing date as May 20, 2026.

The court divided the compensation amount

While dividing the compensation amount, the tribunal has directed to give Rs 49,61,866 to the wife of the deceased and Rs 5 lakh each to his four children. Actually, on the afternoon of 29 October 2021, Bal Kishan was going from Andhope in Palwal towards Sihol on his motorcycle HR-52-G-7376. When he reached near Kidwari of Chandhat, the truck UP-65-JT-9892, which was being driven at high speed and carelessly, hit his motorcycle. After the collision, Bal Kishan fell on the road and suffered serious injuries. After the accident, he was taken to Palwal District Hospital, where doctors declared him dead.
