Big relief to Rahul Gandhi, court rejects monitoring petition, refuses to interfere in magistrate’s order

Sultanpur. Congress MP Rahul Gandhi has got relief from the MP-MLA Court in the defamation case related to his alleged controversial remarks on Union Home Minister Amit Shah. The court of Special Judge Rakesh Yadav rejected the monitoring petition of BJP leader Vijay Mishra. The court refused to interfere with the order of the Magistrate Court. With this decision, the way has been cleared for the hearing of the pending defamation case in the Special Magistrate’s court.

Now the case will be heard on July 18. The special judge said in his order that it was not appropriate to stop the proceedings pending final arguments in the Magistrate Court. The court held that the monitoring petition filed by the complainant is not acceptable. This case was filed by BJP leader Vijay Mishra in the year 2018. It is alleged that Rahul Gandhi had made controversial remarks regarding Amit Shah.

Demand for voice sample rejected

During the hearing of the case, Vijay Mishra had demanded a sample test of Rahul Gandhi’s voice on March 12. The court of Special Magistrate Shubham Verma had rejected this application on May 2. He had ordered to submit the bail bond and proceed with the final arguments. Vijay Mishra had challenged this order in the MP-MLA Sessions Court. On Wednesday, the special judge rejected his petition.

No relief received from two courts

Rahul Gandhi’s demand to get his voice sample tested was earlier rejected by the Special Magistrate Court. Now the monitoring petition filed against the same order has also been canceled by the MP-MLA Sessions Court. After not getting relief from two consecutive courts, the complainant BJP leader is being considered as a legal setback.
