When the court took the decision, commenting on the functioning of the Narcotics Control Bureau (NCB), it also said that the investigating agency had not followed the legal procedures properly when it had closed the accounts. The court made it clear that under Section 68F of the NDPS Act, it is very important to get confirmation from the competent authority within 30 days of freezing any assets, and this work was not done in this case.
For your information, let us tell you that these accounts were closed in the year 2020 itself, when the investigation into the drugs case started after the death of actor Sushant Singh Rajput. Actress Rhea Chakraborty was facing problems for almost four years in meeting her financial needs due to closure of accounts.
The special judge, while accepting the actress’ plea, said that there were procedural flaws in the legal action of confiscation, hence these accounts cannot be kept closed any longer. After this, now Rhea and her family will be able to transact normally from their bank accounts.
