MP Court’s decision: A married woman can live with the person of her choice as per her wish, not only the family but even the society cannot stop her.

Madhya Pradesh The Indore bench of the High Court has given a very important and thought-provoking decision. The court has said in clear words that if a woman is a full-fledged adult, then whether she is married or not, she is completely free to live with any person of her choice. No one can stop him by force. The court also stressed that the right to choose one’s way of life and personal liberty are fundamental rights guaranteed by the Indian Constitution. No one can snatch these rights in the name of family pressure or society’s thinking.

This whole thing came to light during the hearing of a Habeas Corpus Petition. This petition was filed by a person named Dheeraj Nayak, resident of Sawai Madhopur, Rajasthan. Dheeraj Nayak had applied in the High Court through his lawyer Jitendra Verma that a woman named Sandhya wants to live with him of her own free will, but the woman’s parents are forcibly keeping her with them. They are taking away his freedom and not allowing him to go near Dheeraj.

what does the woman say

When the case was heard on Friday, the woman named Sandhya was presented before the High Court under police protection. In the court, the woman gave her statement in very clear and unambiguous words. She said that she is a completely adult, has her own understanding and wants to live with Dheeraj Nayak completely of her own free will. The woman also alleged that her parents were keeping her confined at home against her will. They are putting various kinds of pressure on him so that he changes his decision.

‘Live with your husband and not with anyone else…’

On the other hand, the woman’s parents presented their arguments in the court. He said that his daughter is already married, so she should live with her husband. The respect of the family, the norms and traditions of the society, everything is at stake. He said that this decision of his daughter is not right and it should be stopped.

Society has no right to stop him

But the High Court carefully listened to all the arguments of both the sides and then gave its decision. The judges said that the biggest and most important fact in the eyes of law is that the woman is an adult, she is fully capable of taking decisions about her own life. The court also made it clear that getting married does not end a woman’s personal freedom. If she wants to live happily with another person, then no one has the right to stop her, neither the family nor the society.

The woman kept repeating the statement

In fact, in the earlier hearing held on December 2, the High Court itself had directed that the woman’s statement should be recorded properly. On the orders of the court, a judicial magistrate also took separate statements from the woman. In those statements also, the woman had repeatedly reiterated that her parents were forcibly keeping her in their custody and she wanted to leave with patience. Finally, after Friday’s hearing, the High Court took a big and bold decision. The court gave full permission to Sandhya to go with Dheeraj Nayak. The handover of the woman was also handed over to Dheeraj Nayak. Also, the court gave strict instructions to the police to take both of them safely to Sawai Madhopur, so that no untoward incident happens on the way and no danger arises.
