Nand Nagari road accident: Delhi Police conducted ‘fake’ investigation, fraud? 3 families did not receive compensation; Know the whole matter

The night of 2 February 2018 was no less than a disaster for three families in Nand Nagari, Delhi. Ravi Kumar, Satish Kumar and Rohit, riding on the same bike, died tragically in a horrific road accident. After this accident, the relatives of the deceased approached the Motor Accident Claims Tribunal (MACT) in the hope of justice and compensation. But the decision that came after almost 8 years long legal battle, gave a deep shock to the families.

After almost an 8-year long legal battle, the Motor Accident Claims Tribunal (MACT) rejected all the petitions related to compensation. It has been reported that this decision was affected due to the negligence of Delhi Police and the alleged ‘fake’ investigation. Serious lapses in the investigation not only changed the course of the entire case but also misled the course of justice. The brunt of this negligence had to be borne by those families who had been waiting for justice and compensation after the death of their loved ones for the last 8 years.

Big upset in investigation

In the case, which took place in Nand Nagari, Delhi, the tribunal found that the chargesheet and the Detailed Accident Report (DAR) filed by the police were full of contradictions. Investigation revealed that the truck whose number was initially mentioned as HR-55G-7002 by eyewitnesses and police records, was considered responsible for the accident. But as soon as the fact came to light that the truck was not insured, the statements of the witnesses suddenly changed and a new truck number HR-69A-0881 started emerging whose insurance was valid.

The most surprising thing was that the owner of both the trucks was the same person. In view of this situation, the tribunal considered the entire case as ‘planted’ i.e. fake and said that it could not be proved that the accident actually happened due to another truck. The court also commented strongly on the role of the investigating officer. Neither the location of the witnesses was investigated nor the primary evidence related to the incident was properly seized. These serious flaws weakened the entire case and ultimately all the compensation petitions were rejected.

‘The case has been closed’

Lalit, brother of the deceased Ravi Kumar, said that after continuously making rounds of the courts for 8 years, his family is completely devastated. He said that Ravi lived with his elderly mother and after her death, the financial and emotional condition of the family has become very bad. Lalit alleges that his rights were snatched away due to delay in getting justice and alleged negligence of Delhi Police. He says that if there had been proper investigation in the beginning, perhaps the decision would have been different today.

The story of deceased Satish Kumar is most heart-wrenching. After the death of his father, he got the job of LDC (Lower Division Clerk) in Tihar Jail on compassionate grounds. He was the sole support of his five sisters and ailing mother. After the accident, the financial backbone of the family was broken. Four sisters are still unmarried and the condition of the house has become very pathetic. At the same time, the condition of the third deceased Rohit was also no less painful. He had lost his parents just a month before the accident. After this he was living with his brothers and trying to take care of the family, but this accident also took away his life.

Police’s functioning described as ‘biased’

The Motor Accident Claims Tribunal (MACT) has made strong remarks on the functioning of Delhi Police, terming the investigation into the Nand Nagari road accident as ‘biased’. In this case, which took place in Nand Nagari, Delhi, the tribunal has directed the concerned District Deputy Commissioner of Police (DCP) to take strict punitive action against the guilty investigating officer.

Also, the court has ordered that a copy of the case be sent to the Delhi Police Commissioner, so that the entire case can be reviewed and such rigging in the investigation process can be prevented in future. Despite this strict stance of the court, the saddest aspect is that even after 8 years of long legal battle, the victims’ families have neither got justice nor compensation, they are still empty handed.
