‘No demolition should be done at the house of the accused till March 11’, High Court orders to MCD on Uttam Nagar case

The court has given order in the case of bloody clash that took place on the day of Holi in Delhi’s Uttam Nagar area. The Delhi High Court on Tuesday asked the MCD not to take any demolition action till March 11 on two houses of people involved in the Uttam Nagar Holi clash case, in which a 26-year-old man was killed.

Nothing should happen till tomorrow – Court

Justice Amit Bansal accused Imran’s mother Zarina and Shehnaz, whose children were interrogated by the police. While hearing the petitions of these two, he said, ‘Tell them, nothing should happen between 4 o’clock now and 10:30 am tomorrow when this matter will be taken up. List tomorrow.

The hearing of the case is also on Wednesday

The petitioners had sought directions to protect their residential premises in JJ Colony, Uttam Nagar from ‘arbitrary and illegal’ demolition. The lawyer appearing for the officers requested the court to hear the matter on Wednesday.

Atmosphere of fear and insecurity in the area

The counsel for the petitioners said that in the meantime they should be given interim protection. Zarina said in her petition that the demolition of the house of accused Umardeep by the Municipal Corporation of Delhi (MCD) has created an atmosphere of fear and insecurity in the area, giving rise to a real fear that his house can also be demolished without following the correct process of law.

The family members of the accused are receiving threats

The petition states that demolition cannot be used as a punishment in a criminal case, for this it is necessary to issue a show-cause notice and give an opportunity of hearing to the affected people. Both the petitioners said in their appeal that a ‘purely personal’ dispute has been deliberately given a communal color and some religious groups and anti-social elements are also threatening them.

According to MCD officials, the corporation was not forced to give advance notice in the anti-encroachment drive. Several people, including a minor, have been arrested in connection with the death of a 26-year-old man following a long-running feud between two neighboring families during Holi celebrations in southwest Delhi’s Uttam Nagar.
