Opposition preparing to remove Justice Swaminathan, 107 MPs sign impeachment motion
New Delhi : A total of 107 MPs from Congress, DMK and Samajwadi Party (SP) petitioned Madras High Court Justice G.R. Have signed the application demanding disciplinary action against Swaminathan. The MPs allege that the judge’s decisions reflect political ideology and a tendency to take decisions against the secular principles of the Indian Constitution. The opposition also alleges that the judge gave “undue favour” to lawyers from a particular community and a senior advocate, which raises questions on the impartiality and transparency of the judiciary.
BJP trying to create communal tension
DMK MP Kanimozhi submitted this application to Lok Sabha Speaker Om Birla. Congress’s Priyanka Gandhi and Gaurav Gogoi, SP’s Akhilesh Yadav, NCP’s Supriya Sule and AIMIM’s Asaduddin Owaisi were also present with him. This matter has already become the center of political debate. DMK MP T.R. Baalu alleged that the BJP was trying to create communal tension in the state even though elections were to be held in a few months.
Clash between government and opposition
Union Minister and BJP MP L. Murugan hit back and said that the state government was restricting the devotees’ right to worship. At the same time, Union Minister Kiren Rijiju said that no negative comments should be made on the judiciary. This controversy has deepened the conflict between the judiciary and political parties.
Swaminathan’s order started the controversy
This controversy started with the order of Justice Swaminathan on 1 December. The court said that the Arulmigu Subramaniam Swamy temple will have to be allowed to light the lamp on the stone lamp post called ‘Deepthoon’ located on the Thiruparankundram hill. When the administration did not allow the devotees, on December 3 the court ordered that the devotees themselves light the lamps and the Central Industrial Security Force (CISF) ensure their security.
Government did not implement HC order
However, the state government did not implement the High Court order and filed a challenge in the Supreme Court. The Madurai High Court bench had rejected the appeals of the District Collector and the City Police Commissioner. This controversy has now become a subject of political and legal confrontation between the Lok Sabha and the judiciary, in which questions like impartiality of the judiciary, accountability of the administration and protection of secularism are being raised. This entire matter has given rise to deep debate between political parties and the judiciary, and its political and legal consequences may prove to be significant in the times to come.
