Order for premature retirement of six judges in Gujarat
Bureau Prayagraj- The state government has directed six judges to take “premature retirement” from the judiciary “in public interest”, with immediate effect. This order was issued after the recommendations made in this regard by the Gujarat High Court. Five of them are district judges, while one is a senior civil judge. The Law Department of Gujarat Government issued notifications in this regard on 16 March.
The five district judges who have been asked to take premature retirement are: Prathamesh Srivastava, Principal District Judge, Morbi; Prashant Joshi, Principal Judge, Family Court, Morbi; Mohammad Ilyas Mandali, Principal Judge, Family Court, Porbandar; Ali Hussain Shaikh, Third Additional District Judge, Rajkot (Dhoraji); and Kirit Kumar Darji, Additional District Judge, Aravali (Modasa).
The sixth judicial officer has been identified as Jayesh Kumar Parikh, Principal Senior Civil Judge and Additional Chief Judicial Magistrate, Dhrangadhra (Surendranagar district). Sources said the order for premature retirement of these six judges has been issued under the provisions of the Gujarat Civil Services (Pension) Rules, 2002, read with Rule 21 of the Gujarat State Judicial Service Rules, 2005; The reason why a member should be retired in the public interest under sub-rule (1) shall be considered at least three times; That is, when he is about to complete 50 years, 55 years and 58 years of age.”
