A separate State Backward Classes Commission will be constituted to determine the reservation for Other Backward Classes (OBC) in the proposed three-tier Panchayat elections in Uttar Pradesh. An affidavit to this effect has been given by the state government during the hearing of the PIL in the High Court. This commission will conduct a survey and submit its report to determine the reservation for OBCs. On the basis of his report, reservation will be implemented and then Panchayat elections will be held.

This case was heard by the court of Justice Rajan Rai and Justice Awadhesh Chaudhary in the Lucknow bench of Allahabad High Court. In the ongoing hearing regarding reservation for Other Backward Classes (OBC) in the three-tier Panchayat elections, a reply has been filed by the Uttar Pradesh government that an OBC Commission will be formed, which will work completely focusing on the process of deciding reservation for the OBC category in the three-tier Panchayat elections.

The reason for the formation of the commission is that it was said in the PIL that after the end of the three-year tenure, the present OBC Commission no longer has the legal right to work like a dedicated OBC Commission. On behalf of the petitioner, it has been said in the High Court that if an OBC Commission with a three-year tenure had existed, then there would have been no need to constitute a separate commission, but the tenure of the three-year commission has ended in October 2025 and the government has extended the tenure for one year, but the constitutional position is that during this extended tenure, the present commission cannot conduct surveys etc. for the reservation of OBCs. Therefore, a new OBC commission will be constituted by the government for this work. This commission will conduct a rapid survey of OBCs in the entire state and on the basis of its report, reservation of seats in Panchayat elections will be decided according to the population of backward classes. Panchayat elections will be held only after this.
