Pawan Kheda will not be able to escape arrest? Understand the meaning of the Supreme Court’s decision
Congress leader Pawan Kheda’s troubles may increase. The Supreme Court has now refused to extend the stay on possible action against him. The Supreme Court has said that if Pawan Kheda wants anticipatory bail then he should approach the courts of Assam. This case is related to the allegation of possessing a fake passport against Riniki Bhuyan Sarma, wife of Assam Chief Minister Himanta Biswa Sarma. Later, Telangana High Court gave relief to Pawan Kheda and granted him one week’s anticipatory bail. The Supreme Court had stayed this decision of the High Court on April 15 and said that they should approach the High Court.
Pawan Khera had filed a petition in the Supreme Court demanding that he be given protection till March 20 and no punitive action should be taken against him. On this, the Supreme Court said that Pawan Kheda should approach the competent court of Assam for this.

Justice J.K. Maheshwari and Justice Atul S. Chandurkar’s bench on Friday took note of the arguments of senior advocate Abhishek Manu Singhvi, appearing for Pawan Kheda, and told the Assam court hearing the Congress leader’s petition that if there are any adverse comments of the Supreme Court and Telangana High Court in this matter, then they should not be taken into consideration. This bench also asked the courts of Assam to hear Pawan Kheda’s petition expeditiously.
Now in this matter Himanta Biswa Sarma has said, ‘I think Pawan Kheda should surrender before the law. The more you run away from the law, the more difficult it becomes. Therefore I would say that let us surrender in Guwahati.
What is the matter?
Congress spokesperson Pawan Khera had alleged in a press conference on April 5 that Assam Chief Minister’s wife Riniki Bhuyan Sharma had multiple passports and properties abroad. Pawan Kheda said that Himanta Biswa Sarma has not made any mention of these properties in his election affidavit. Himanta and his wife had termed these allegations as false and fabricated. Later Riniki Bhuiyan Sarma had filed an FIR against Pawan Kheda. After this, Assam Police reached Pawan Kheda’s house in Delhi. He then went to Hyderabad and filed a petition in the Telangana High Court seeking protection.

On April 15, the Supreme Court had stayed the Telangana High Court order granting one week’s transit anticipatory bail to Kheda in this case. Solicitor General Tushar Mehta, appearing for the Assam government, had argued that it was a case of lack of jurisdiction and Pawan Khera’s petition did not explain why he had approached the Telangana High Court. A case was registered against Pawan Kheda at Guwahati Crime Branch police station under Section 175 (false statement relating to election), Section 35 (right of private defense of person and property) and Section 318 (cheating) of the Indian Justice Code.
