Petition filed in Supreme Court in Jantar Mantar lathi charge case, demand for FIR against policemen
The matter of alleged lathi charge and use of tear gas during the students’ protest at Jantar Mantar in Delhi has once again reached the Supreme Court. In this case, a petition has been filed by lawyer Narendra Kumar Mishra demanding registration of FIR against the policemen who took action against the protesters.
The petition has also sought instructions to safeguard all important electronic and digital evidence related to police action. These include CCTV footage, body-worn camera recordings, drone footage, videos made from mobile phones, social media posts and videos, police wireless and communication records, call logs, control room records and orders related to police deployment.
What did CJI Surya Kant say to the lawyer?
Earlier, during the hearing of the case, Chief Justice (CJI) Surya Kant had told lawyer Narendra Mishra not to waste his time and the court’s time. Referring to the issues of students, Mishra had raised questions like conducting of NEET exam and reforms in NTA.
Amidst the lawyer’s arguments, the CJI said, “Thank you very much.” When Mishra referred to videos related to alleged police excesses, CJI Surya Kant said he had no interest in watching such videos and did not even have time to watch them.
The CJI later clarified that the intent of his comment was that seeking action against Delhi Police on the basis of a mere letter without filing a proper petition amounts to wasting the court’s time.
Students protest at Jantar Mantar
Students and protesters in Jantar Mantar and other areas of central Delhi had protested over alleged irregularities in the examination, paper leak and accountability. The protesters had also demanded the resignation of Union Education Minister Dharmendra Pradhan.
The protesters had planned to march to Parliament House, but Delhi Police stopped them from proceeding. Now, through a new petition filed in this case, a demand has been made for an independent investigation into the police action and to preserve all the evidence related to the alleged lathi charge.
