Delhi: Jaipur’s POCSO court has rejected the anticipatory bail plea of Royal Challengers Bangalore (RCB) fast bowler Yash Dayal in the alleged rape case. The Court believes that it is not appropriate to grant relief to the accused at this stage, because the available evidence and the state of the investigation point towards serious allegations.
Court’s decision on anticipatory bail
According to NDTV report, Jaipur Metropolitan Court Judge Alka Bansal said that the facts and evidence revealed so far do not prove that Yash Dayal has been falsely implicated. According to the court, the investigation is indicating that the role of the pacer may be suspicious, hence it is not possible to grant anticipatory bail at this stage.
what are the allegations
The matter is related to the FIR registered in Sanganer Sadar Police Station, Jaipur. The complainant is a minor girl, who has alleged that Yash lured her into his trap by promising to further her cricket career. According to the victim, the accused blackmailed her and beat and exploited her for about two and a half years. The allegations also mention incidents that took place in hotels in Jaipur and Kanpur.
Important evidence in the investigation
Police is investigating this matter under POCSO law. The investigating agencies are considering the chats, pictures and videos, call records and documents related to the hotel stay found from the girl’s mobile phone as important evidence. On these grounds the police presented its stand in the court.
defense arguments
Yash Dayal’s lawyer Kunal Jaiman argued in the court that his client had met the complainant only in public places and never met him alone. He also said that the girl had declared herself an adult. According to the defense, the complainant took the money citing financial problems and later started asking for more money. The lawyer claimed that another case registered in Ghaziabad is also part of the alleged extortion conspiracy.
Dayal’s side
In his petition, Dayal described the allegations as completely false and fabricated. He said that this case has been fabricated with the intention of harassing him and extorting money. Describing himself as a dedicated and respected person towards cricket, Yash claimed that he was being trapped by a group of women. He also assured the court of full cooperation in the investigation.
Public Prosecutor’s Argument
On behalf of the victim, government lawyer Rachna Mann said in the court that the accused had physical relations with the minor girl by giving her false promises to further her cricket career. After hearing all these arguments and facts, the POCSO court of Jaipur rejected the anticipatory bail plea of Yash Dayal.
