Rouse Avenue Court acquitted 17 people including former minister Somnath Bharti, gave relief in this 12 year old case

A Delhi court has acquitted former minister Somnath Bharti in the midnight raid in Khirki Extension, South Delhi. It is being said that African women were sexually assaulted in this raid. Along with Bharti, the court has acquitted 17 more people. The incident is of 2014. Additional Chief Judicial Magistrate of Rouse Avenue Court, Neha Mittal, has given this decision on Friday.

Detailed order yet to come

The court orally said on Friday that the statements of the victims cannot be considered valid as they did not appear in the court. No case of illegal assembly has been proved. The prosecution failed to prove its case. The prosecution could not even prove the delay in registering the case. The detailed order of this decision is yet to come.

Now know what is the whole matter

On the intervening night of 15 and 16 January 2014, Somnath Bharti, the then Law Minister and AAP MLA from Malviya Nagar, led a group of people. He was accused of harassing and attacking women from African countries during this period. The accused had claimed that the women were involved in illegal activities. The prosecution claimed that many women were injured. It is alleged that a drugs and prostitution racket was allegedly being run at that place. He had received many complaints due to which he conducted the raid.

A case was registered in these cases

In 2018, the court had framed charges of molestation against Bharti and others. The court had said at that time that prima facie there was enough evidence to proceed with the trial against all the accused. The court had framed charges against Bharti and others under sections 147/149, 354, 354C, 342, 506, 143, 509, 153A, 323, 452, 427 and 186 of the IPC. Delhi Police had mentioned 41 witnesses in the charge sheet to prove its case, including nine African women.

Police registered FIR on the instructions of the court

The police had registered an FIR on the instructions of the court. The victim woman had demanded registration of a criminal case against the people involved in the incident.
