SC reprimands Elvish Yadav, makes strict remarks in snake poison case
YouTuber and Bigg Boss OTT winner Elvish Yadav has to face harsh remarks from the Supreme Court in the snake and poison case. Elvish had filed a petition challenging the charge sheet and criminal action filed against him. While hearing this, the Supreme Court bench adopted a strict stance. Justice M.M. Sundaresh and Justice N. Kotishwar Singh’s bench said that such acts by celebrities give a wrong message to the society. The court also made it clear that the case will be investigated under the Wildlife Protection Act.
Court’s strict comment
During the hearing, the court said, “If a popular person like you is allowed to use voiceless and protected animals in this manner, then a wrong message will be sent to the society. We will look into the provisions of the Wildlife Protection Act. Snakes are protected species, they cannot be harmed.”
What argument did the lawyer give?
Senior advocate Mukta Gupta, appearing for Elvish, argued that the snakes did not belong to him and they had only made a guest appearance in a music video. According to him, the snakes were brought by someone else and were handled by the same person. He also said that necessary permissions were taken for the video in question and the snakes were not poisonous. On this, Justice Sundaresh questioned whether Elvish had handled snakes or not. The court has asked the prosecution to file a report within two weeks, in which it will be clarified whether the necessary permission was taken or not.

On behalf of the complainant, it was said that as per the statement of an officer in the charge sheet and the government counter affidavit, the venom sac of a python was intact. On this Justice N. Kotishwar Singh commented on how a python can be poisonous, as it kills its prey by strangulating it. The court said it would have to examine the validity of the complaint and any violation of law. At present the hearing has been postponed for two weeks.
What is the whole matter?
This case dates back to November 3, 2023, when Noida Police received information about the use of snake venom in a rave party. The police raided and recovered 9 snakes including a cobra and registered a case against 5 others including Elvish Yadav. This action was taken on the basis of a complaint by an NGO associated with BJP MP Maneka Gandhi. Elvish Yadav also had to go to jail in this case. Now the Supreme Court has directed to submit a detailed report in two weeks, after which further hearing will be held in the case.
