Prayagraj ADJ Rape and POCSO Special Court has issued important instructions in the case of sexual abuse allegations related to Shankaracharya Swami Avimukteshwarananda Saraswati of Jyotish Peeth. The court has asked Jhunsi police station to register an FIR against Swami Avimukteshwarananda Saraswati and his disciple Swami Mukundanand Giri and conduct a proper investigation. On the other hand, Swami Avimukteshwarananda has termed all the allegations as baseless and has demanded immediate action in the matter. Commenting, he said, ‘We are not Yogi Adityanath who can get the charges against us removed.

Responding to the allegations, Swami Avimukteshwarananda said that the case leveled against him is completely false and the truth will soon come out. He said that the complainant himself is a history-sheeter and his name is registered in many cases. Swami also says that the allegation leveled against him has not been made by any outsider, but by a disciple of Ram Bhadracharya.

Doubt expressed on police investigation

He urged the court not to keep the case pending unnecessarily and to take prompt action. Swami Avimukteshwarananda also said that he would face the allegations firmly. Besides expressing no full confidence in the police investigation, he has demanded a high-level inquiry into the entire matter. Swamy said that he is ready to provide all possible cooperation to the investigating agencies.

ADJ POCSO court instructions

ADJ POCSO Act Judge Vinod Kumar Chaurasia has made it clear in his order that a legal case should be registered against both the accused and an impartial investigation should be conducted. Following the instructions of the court, Jhunsi police station will now register an FIR and start further legal process. It is believed that after this decision, the legal challenges of Swami Avimukteshwarananda Saraswati may increase.

The application was given under section 173(4)

Ashutosh Brahmachari, associated with Shakumbhari Peethadhishwar and Shri Krishna Janmabhoomi Mukti Nirman Trust, had filed an application in the court under Section 173 (4) on January 28, demanding registration of an FIR. They allege that incidents of sexual harassment of minor children take place in the ashram of Swami Avimukteshwarananda Saraswati. He has also claimed to have submitted a CD in this regard to the court.

In this case, on February 13, the statements of both the minors who made the allegations were recorded in the court with videography. During the hearing, the court also took the police report into cognizance and reserved the decision. Now the court has issued the order to register FIR.
