Occupancy of fields, encroachment on roads or deliberate obstructions occur frequently due to disputes over generational rights, land boundaries and attempts to maintain dominance among themselves. Such disputes not only increase tension among farmers, but also disrupt farm operations, transportation of crops and daily life to a large extent.

In this background, the state government has taken a very strict and decisive step. Strict rules are now in place to stop encroachment and encroachment on farm roads. According to the new decision, if anyone blocks the farm road, encroaches on it illegally or obstructs the rights of other farmers, the Aadhaar card and Farmer ID of such a person will be directly blocked. Not only this, but the benefit of all the government schemes available to such farmers will also be completely stopped. This means that the concerned person will also be deprived of schemes like crop insurance, subsidy, loan waiver, discounts on seeds and fertilizers. So, this decision is going to be very serious and impactful for the farmers.

This important decision has been taken under the ‘Chief Minister Baliraja Shet/Panand Road Scheme’. Under the guidance of Chief Minister Devendra Fadnavis, Revenue Minister Chandrashekhar Bawankule has implemented this decision and the Government Decision (GR) in this regard has also been officially issued. Due to this, the administration has now also got clear powers to take action.

According to the new rules, if anyone has encroached on the farm lands shown on the village map (Agriculture News) or the government-owned farms, then the concerned Tehsildar will issue a 7-day notice to that person. This notice shall direct the removal of the encroachment on its own. However, if the concerned person does not remove the encroachment within the given time, then the Tehsildar himself will take the initiative to remove the encroachment. Along with this, there is a strict ban on damaging farmland, destroying roads or deliberately planting crops to block roads. In particular, any kind of cultivation or obstruction on roads where other farmers have legal access would be completely illegal. Even in such cases the concerned farmer’s Aadhaar card and Farmer ID will be blocked for 5 years.

Another important decision under the ‘Chief Minister Baliraja Shet/Panand Road Scheme’ is that there will be no compulsory land acquisition for farmers. The government will not force the farmers. However, if a farmer is willing to give land for a road voluntarily, he will need to register a donation deed, gift deed or quitclaim deed.

Farmers have been given a big relief in this process. Because, the stamp duty and registration fee charged on these donation letters in favor of the government will be completely waived. Therefore, there will be no additional financial burden on the farmers. The land given will be officially registered and recorded on the 7/12 statement of the farmer concerned. Importantly, once the land is given, the concerned farmer has no right to claim it back.
